Posted messages may be indexed by Internet search engines for the world to see them.
You may or may not receive e-mail messages from others (other consumers, businesses, etc.) due to posting your message on ShamScam.com. We never share your email address!
As a user of ShamScam.com, you acknowledge that ShamScam.com does not prescreen or edit posted complaints. You alone are responsible for the content of your messages, and the consequences of any such messages.
When messages have been posted to ShamScam.com they are made available for public view, and made available for indexing and reproduction by third-party search engines and directories. ShamScam.com has no control over the content taken from ShamScam.com by third-party sites.
ShamScam.com is not responsible for the validity of the consumer message complaints posted to the ShamScam.com site.
ShamScam.com is not responsible, in any way, for providing, or helping to provide, businesses' responses to the consumer complaints that are posted on the ShamScam.com site, and /or forwarded to businesses.
ShamScam.com does not knowingly allow incorrect or factually incorrect information to remain posted. If ShamScam.com is instructed to remove and delete a posted message by a court, then the message will be removed and deleted.
If at any point you as a user of ShamScam.com posts or attempts to post anything including but not limited to spam or advertisements your post will not be approved. Instead, the company and/or individual name will be posted on ShamScam.com as a spammer and a scammer. The exact rewording of the post is at the sole discretion of the administrators of ShamScam.com.
Many complaints posted to ShamScam.com are an historical 'snapshot' of an ongoing situation, as seen through the eyes and perception of an individual consumer, often with incomplete or inaccurate information at their disposal.
ShamScam.com always assumes that the consumer has a positive intent in writing their message, in helping themselves, in helping other consumers, in helping the subject business provide a better product or service.
A complaint listed is assumed by ShamScam.com to be a description of a situation experienced by a consumer. A complaint is only a personal opinion by a consumer, a perception of a consumer. That personal perception and/or opinion based on their own personal experience can be powerful, or meaningless, in the opinion of ShamScam.com, depending upon the context and content of what is written. And how that information is interpreted by whomever reads it. Which of course varies from person to person, depending on whom they are, their own personal experiences, biases, opinions, etc.
No conclusions are drawn by ShamScam.com, as to content validity. ShamScam.com does not edit or censor posted messages or investigate them for accuracy.
Posted messages should describe a personal, firsthand experience. If a person experienced something personally, that person owns that information about their perception of, and opinion about, that personal experience, and is free to discuss their opinion about that experience, as a human, citizen, and legal entity, unless previously, already contractually bound otherwise.
It is the responsibility of a message author to make sure they are not contractually bound otherwise. It is the responsibility of this message author to determine on their own if they are not allowed to discuss the subject of their complaint, if this is the case, prior to posting a message to ShamScam.com.
If this ShamScam.com site user is contractually bound not to discuss a subject, that message author takes it upon their own risk if they post a message to ShamScam.com about that subject, because that message will be posted on ShamScam.com for public view.

ShamScam.com is only a platform for consumers to post complaints; ShamScam.com does not lookup or provide e-mail addresses for the subject businesses.
ShamScam.com is not responsible for helping consumers resolve their complaints. ShamScam is only a tool that consumers can use to try to help them.
By submitting a complaint, you grant the owner of this site, ShamScam.com, the irrevocable, transferable, worldwide right to use, reproduce, and display any such information for any purpose commercial or otherwise without compensation to any party.
2. Member Conduct
As a condition of your use of the Service, you warrant to ShamScam.com that you will not use the Service for any purpose that is unlawful or prohibited by these terms, conditions, and notices.

Transmit or upload any material that contains software or other material protected by intellectual property laws, rights of privacy or publicity or any other applicable law unless you own or control the rights thereto or have received all necessary consents.
Interfere with or disrupt networks connected to the Service or violate the regulations, policies or procedures of such networks.

Interfere with another member's use and enjoyment of the Service or an individual’s or entity's use and enjoyment of similar services.
ShamScam.com has no obligation to monitor the Service or any user's use thereof or retain the content of any user session. However, ShamScam.com reserves the right at all times to monitor, review, retain and/or disclose any information as necessary to satisfy any applicable law, regulation, legal process or governmental request.
3. Indemnity
You will defend, indemnify, and hold harmless ShamScam.com, its officers, directors, employees, agents and third parties, for any losses, costs, liabilities and expenses (including reasonable attorneys' fees) relating to or arising out of your use of ShamScam.com, including, but not limited to, any breach by you of the terms of use.

Opinions, advice, statements, offers, or other information or content made available through ShamScam.com are those of their respective authors and not of ShamScam.com, and should not necessarily be relied upon. Such authors are solely responsible for the accuracy of such content. ShamScam.com does not guarantee the accuracy, completeness, or usefulness of any information on ShamScam.com and neither adopts nor endorses nor is responsible for the accuracy or reliability of any opinion, advice or statement made. Under no circumstances will ShamScam.com be responsible for any loss or damage resulting from anyone's reliance on information or other content posted on ShamScam.com.
5. Removal of Information
Update: We now charge an admin fee of $399.00 to review questionable complaints. We will review certain types of complaints for possible moderation. If we feel that the complaint crosses certain boundaries, it may be removed at our discretion.
By posting information on ShamScam.com, you understand and agree that the material will not be removed even if you the user requests it. Once a complaint is filed you may add to the complaint to notify viewers of any changes or resolutions to your original complaint. You shall remain solely responsible for the content of your postings on ShamScam.com. While we do not and cannot review every message posted by users of the Service, and are not responsible for any content of these messages, we reserve the right, but are not obligated, to edit, delete or remove profanity, obscenities, threats of physical violence or damage to property, email addresses, and private financial information such as social security numbers and credit card information. ShamScam.com also reserves the right to suspend, remove, edit, and delete any complaints that pose a conflict of interest or posted without a proper title format. The format of a complaint title should be Company Name - Did This To Me.
If your company/business is listed on ShamScam.com and you wish to have it removed please read below:
1. Threatening To Sue ShamScam.com will not get your complaint removed. There are several legal reasons why you can not sue us. Consult with an attorney and have them look in to the laws regarding the situation for more details. Having your attorney threaten us will not get your complaint removed.
2. Offering us money will not get your complaint removed. If you offer us money we will tell you no and ignore any further communication.
3. As a business we understand that your online reputation is important. We allow you to create a free account on ShamScam.com and file a comment (Rebuttal) at no cost to you. Simply telling your side of the story shows that you are willing to confront the situation. If you settle the complaint with original person who filed the complaint, they are always able to post the positive outcome of the situation.
4. Threatening us harm: This will get you landed in jail most likely. We take all threats of injury and harm very seriously. All threats of this type will be documented, recorded, and forwarded to the proper authorities (State, Local, and Federal).
5. We protect the First Amendment rights of our users by safeguarding their privacy to the fullest extent of the law. This means that ShamScam.com will not release the contact information of any user of the website without alawfulcourt order; even then we will contest the order to the fullest extent of the law.
6. No Spam, Damages
ShamScam.com will immediately terminate and ban any account, which it believes, in its sole discretion, is transmitting or is otherwise connected with any Spam or other unsolicited bulk e-mail.
7. Limitation of Liability
In no event will we be liable: (i) to you for any incidental, consequential, or indirect damages arising out of the use of or inability to use ShamScam.com, even if ShamScam.com or its agents or representatives know or have been advised of the possibility of such damages or: (ii) to any person other than you. In addition, ShamScam.com disclaims all liability, regardless of the form of action, for the acts or omissions of other members or users (including, but not limited to, unauthorized users, or "hackers" of ShamScam.com.
8. IP Ban and Account Termination
ShamScam.com may terminate and ban your access to any part or all of the Service and any related service(s) at any time, with or without cause, with or without notice, effective immediately, for any reason whatsoever.
